The West Bengal government on Tuesday moved the Calcutta High Court to file an appeal seeking death penalty of the convict in the RG Kar hospital doctor's rape and murder case and secured the court’s necessary permission.

The convict Sanjay Roy was sentenced to life imprisonment by a trial court in Kolkata on Monday in the August 2024 rape and murder of a post-graduate trainee doctor at the city’s RG Kar Medical Colleg

Sanjay Roy was earlier awarded life imprisonment after being convicted of raping and murdering a doctor at RG Kar Medical College And Hospital.

The appeal was accepted by a division bench of justice Debanshu Basak and justice Shabbar Rashidi. After the court pronounced the sentence, chief minister Mamata Banerjee had announced on Monday evening that the state would approach the Calcutta High Court challenging the verdict.

Advocate General Kishore Dutta has filed a plea before Justice Debangshu Basak of the division bench of the high court, seeking the maximum punishment for Sanjay Roy.

Judge Anirban Das questioned why the FIR in the case was registered after 11:30 pm when the incident was reported on the morning of August 9 last year.
